Terms of Service

The terms governing your use of OCboard's AI anime original character generation service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and OCboard ("OCboard", "we", "us", or "our") and govern your access to and use of our website and AI-powered anime original character ("OC") generation service (the "Service"). OCboard is operated by an individual sole proprietor trading under the name "OCboard"; you can reach the operator at support@ocboard.app. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Age Requirements

You must be at least 13 years old to use the Service, or older if your country sets a higher minimum age for using online services or for consenting to the processing of your personal data (for example, 16 in much of the EU/EEA). Where we rely on your consent to process personal data, we require the minimum age applicable in your country.

The Service is primarily a general-audience product, and no tier produces sexually explicit content. Some bolder styling options (the "Untamed" tier; see Section 5) are made available only to users who confirm they are 18 or older. We may require age confirmation, store the fact that you confirmed it, and suspend access if we believe these requirements are not met.

3. The Service

OCboard generates full-body anime-style original character illustrations from the descriptions, traits, and prompts you provide, and may offer related features such as AI prompt-assistance and, where available, short character video generation. Outputs are produced by third-party AI models and are inherently probabilistic — we do not guarantee that any particular result will match your expectations, be unique, or be free of similarity to other outputs generated from comparable inputs.

OCboard is an independent product and is not affiliated with, endorsed by, or sponsored by the providers of the underlying AI models. Any model or product names are used only to describe interoperability.

4. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate information and to notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Content Tiers

The Service offers tiered styling settings that adjust artistic intensity only:

  • Safe and Stylish are general-audience styling tiers.
  • Untamed is an age-gated mature styling tier, available only to users who confirm they are 18 or older. It permits limited, non-explicit mature anime styling, such as stylized swimwear, fashion-forward outfits, or more dramatic poses, within character reference generation. Untamed does not permit nudity, sexual acts, pornographic content, sexualized minors or minor-presenting characters, or content intended primarily for sexual gratification. Those limits apply to every tier, including Untamed. We use automated safeguards and moderation to reject, downgrade, or remove content that violates these limits.

Selecting a tier never overrides the prohibitions in Section 6. All tiers remain subject to automated content moderation, and we may block or remove any output that violates these Terms regardless of the tier selected.

6. Acceptable Use and Prohibited Content

You agree not to use the Service to create, request, upload, or distribute content that:

  • depicts real, identifiable people (including celebrities and public figures) or attempts to impersonate them;
  • infringes the intellectual property rights of others, including copyrighted or trademarked characters, or that is designed to imitate a specific protected franchise or character;
  • sexualizes, or could reasonably be interpreted as sexualizing, minors, minor-presenting characters, or any person or character whose age is ambiguous — including any fictional, stylized, or anime character — this is strictly prohibited, enforced with zero tolerance, and may be reported to the appropriate authorities;
  • is sexually explicit or pornographic, depicts nudity or any sexual act (including non-consensual or violent sexual acts), or is otherwise adult content intended primarily for sexual gratification — this is prohibited on every styling tier, including Untamed, with no exceptions;
  • depicts graphic violence, gore, self-harm, or content that promotes hatred, harassment, terrorism or violent extremism, or discrimination;
  • is unlawful, defamatory, or violates the rights or privacy of others; or
  • attempts to bypass, disable, or interfere with our safety, moderation, rate-limiting, or security systems.

Limited, non-explicit suggestive styling may be permitted only on the Untamed tier, only for users who confirm they are 18 or older, and remains subject to all safeguards, moderation, and the limits above.

Every generation prompt is screened through the Creem Content Moderation API, and we apply additional automated moderation to detect prohibited content. We may block prompts and outputs, refuse service, remove content, and suspend or terminate accounts for violations. See our Acceptable Use Policy for the full list of prohibited uses. These moderation decisions are made by automated systems; if you believe a decision was made in error, contact us at support@ocboard.app to request human review.

7. Your Content and Rights to Outputs

As between you and OCboard, you retain such rights as you may have in the inputs you provide and the images you generate, subject to these Terms and to the rights of third parties. You grant us a worldwide, non-exclusive license to host, store, process, and display your inputs and outputs solely as necessary to operate and improve the Service.

You acknowledge that, under the laws of many jurisdictions, AI-generated images may not be eligible for copyright protection, and that we make no representation that your outputs are protectable or exclusive. You are responsible for ensuring your use of any output is lawful and does not infringe the rights of others.

You may use the OC images you generate for personal and commercial purposes, except where prohibited by these Terms or by law, and subject to any plan or credit limits.

8. Credits and Payments

Some features require credits. Credits are sold through our Merchant of Record, Creem, which is the seller and reseller of record for these purchases and handles billing, invoicing, refunds, and chargebacks; your purchase is therefore also subject to Creem's terms and privacy policy. For billing questions you can contact us at support@ocboard.app and we will assist or direct you to Creem.

Credits are a limited license to use the Service, have no monetary value, are not transferable, and, except as set out below or as required by applicable law, are non-refundable. Prices, credit costs, and free-tier allowances may change. Free daily allowances are provided at our discretion and may be modified or withdrawn at any time.

Automatic refunds. If a generation fails, or its output is blocked by our content-moderation systems, the credits for that generation are automatically returned to your balance.

Consumers in the EEA and UK. Where you have a statutory right to withdraw from a purchase of digital content within 14 days, you expressly request that we begin performance immediately when you purchase and start using credits, and you acknowledge that you lose that right of withdrawal for any credits once they have been used. Unused credits may be withdrawn within 14 days of purchase by contacting us.

9. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time. We may impose or change usage limits, free quotas, and feature availability. We are not liable for any modification, suspension, or discontinuation of the Service.

10. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that outputs will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, and nothing in these Terms excludes or limits any non-excludable statutory rights you have as a consumer.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCBOARD AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR USD 50. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for your non-excludable statutory rights as a consumer.

12. Indemnification

You agree to indemnify and hold harmless OCboard and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the rights of others.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the Service, other users, or third parties. Sections that by their nature should survive termination (including Sections 7, 8, 10, 11, and 12) will survive.

14. Governing Law

These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively before the competent courts of that location. Nothing in this section removes any mandatory consumer-protection rights you may have under the laws of your country of residence.

15. Intellectual Property and Takedown Requests

We respect the intellectual property rights of others and expect users to do the same. If you believe content generated, stored, or made available through the Service infringes a copyright or other intellectual property right you own or control, send a notice to support@ocboard.app that includes: (a) identification of the work or right you claim is infringed; (b) identification of the specific content and where it appears (such as a URL or image identifier), sufficient for us to locate it; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and (e) a statement that the information in your notice is accurate and that you are the rights holder or authorized to act on its behalf.

On receipt of a valid notice we will remove or disable access to the content in question. If you believe content was removed in error, you may send a counter-notice to the same address. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
